Commissioners rezone 360 acres near Bruce Yawn Commerce Park

Zoning drew a capacity crowd at the Bulloch County Commissioners meeting on Tuesday night. Eight items approved included a combined 360 acres for the proposed development of warehouses for industrial growth in the area. Read the story for a full report on all county business covered at the meeting.

Bulloch County Board of Commissioners rezoned 360 acres adjoining the Bruce Yawn Industrial Park at their regular bi-monthly meeting on Tuesday, April 4, 2023.The land is owned by six property owners and is proposed to be developed as a warehouse complex to support the industrial growth in the area.  The commissioners approved rezoned the land from Ag-5 to LI (Light Industrial) 

Zoning

DENIED: 1. Brenda and McKinley Talley submitted an application to rezone 51 acres from AG-5 to HC to create a recreational vehicle park and campground. The property is located at 4115 & 4165 Seed Tick Road, Parcel No. 178 000010 000 and 178 000033 000.

James Dasher spoke in favor of the rezoning of the property.  This campground is proposed to be used for construction workers who will need longer term use of the campground.  It is not intended for recreational use or travellers.  This property is eight miles from Hyundai plant and one mile from I-16.

Attorney, Andrew Lavoie spoke against the rezoning and represents a group of concerned property owners who are opposed to this property owners.  Dan and Linda Walker, Randy and Cindy Morris, and David and Cynthia Ann Snyder are a few of the property owners that Lavoie is representing.

David Snyder spoke in also opposition on behalf of the property owners.  He has lived in the area for 26 years.  Traffic is their biggest concern and stretches emergency service agencies according to Mr. Snyder.

APPROVED: 3. Garrett Nevil submitted an application to rezone 66 acres from AG-5 to LI to allow the development of warehouses. The property is located on the south side of Rocky Road.

Zoning items 3 through 8 are all part of the proposed warehouse development including in the rendering below.  The development includes 360 acres.  

James Collins of Thomas and Hutton spoke in favor of the rezoning.

Garrett Nevil one of the property owners also spoke in favor of the rezoning.

Marlin Nevil a property owner near the property spoke in painful favor of the rezoning.  He asked the commissioners to work with them to protect the property owners by enforcing the items that he and other property owners had requested as part of the conditions addressed and agreed to by the developers along with a few other concerns regarding the height of the buffer area.

Lisa Crowe spoke about her concern regarding traffic and access on Union Church Road.

APPROVED: 4. Robert Rushing submitted an application to rezone 69 acres from AG-5 to LI to allow the development of warehouses. The property is located on the south side of Rocky Road.

Robert Rushing spoke in favor of the rezone.

Clayton Anderson a Bulloch County farmer spoke in concern but not against the property rezone.  He is concerned about the impact on the farmland and safety due to increased traffic.  His family has been farming land in this area since 1750.  

Caitlyn Anderson, Clayton's daughter who came to support her dad deferred her comment time to him  

Lisa Crowe spoke in concern about church on Union Church Road.

APPROVED: 5. Tommy Brannen submitted an application to rezone 32 acres from AG-5 to LI to allow the development of warehouses. The property is located on the south side of Rocky Road.

APPROVED: 6. Jennifer and DJ Vickery submitted an application to rezone 14.28 acres from AG-5 to LI to allow the development of warehouses. The property is located on the south side of Rocky Road.

APPROVED: 7. Ricky Nevil submitted an application to rezone 172.84 acres from AG-5/HC to LI to allow the development of warehouses. The property is located on the south side of Rocky Road. Commissioners added an amendment restricting all access to Union Church Road from this property.

APPROVED: 8. Travis Phillips submitted an application to rezone 5.45 acres from AG-5 to LI to allow the development of warehouses. The property is located on the south side of Rocky Road.

APPROVED 9. Discussion and/or motion to approve the proposed modification to the various articles and provisions of Appendix B: Subdivision Regulations.

APPROVED 1. Benefits Broker Selection - Mark III Employee Benefits was selected

APPROVED 2. Motion to enter into negotiations with Goodwin Mill Cawood for the Long Range Transportation Plan (LRTP). This is a shared project with the City of Statesboro.

APPROVED 3. Approval of Bulloch County Stormwater Control Ordinance.

APPROVED 4. Resolution to Object to an Intended Annexation by the City of Statesboro Pursuant to OCGA 36-36-113

For the first time ever Commissioners have objected to annexation of 36.55 acres of property located inside the Bel Air Subdivision.  The property was originally annexed by the City Council as R-2 which is much higher density to the now R-6 which the property owners are requesting.  R-2 reduces includes lot size of 2,000 sq ft residential townhomes. 

After a group of citizens filed and won a legal challenge to the annexation, the property owner in a concession to the concerns of the citizens submitted a new annexation plan which reduces density and increased lot sizes to 6,000 sq ft or R-6.  

The citizens have now appealed to the County Commission to contest the annexation.  With the commissioners historic objection the annexation issue will now be decided by an arbitration panel established by the Department of Community affairs

PUBLIC COMMENTS

Marcus Toole, spoke against the county approving an objection to the annexation of the Bel Air property for proposed single family home development.  He said that with all fhe growth coming to he county this is a minor development based on the need.

He also spoke to the need to review and revise the policy on road paving.

Larry Cone thanked the Commissioners for paving Hood road.
